  1. Scope of application
    1. These Terms of Use govern the use of the EW Gruppe's online documentation platform (hereinafter referred to as the "Platform") by users.
    2. The Stromwerk one Holding GmbH, hereinafter referred to as the "EW Gruppe", is the provider and operator of the Platform.
    3. These Terms of Use apply exclusively. Conflicting or deviating terms and conditions of the user are not recognised unless the EW Gruppe has expressly agreed to their validity.
  2. Registration, conclusion of contract, storage of the contract text and contract language
    1. Use of the platform requires registration and the creation of a user account, which is free of charge for the user.
    2. A permanently used e-mail address is required for registration. The use of "disposable addresses" with only temporary validity is expressly prohibited, as such addresses can be assigned to new users after being "thrown away", which could allow unauthorised access.
    3. After submitting the online registration form, the EW Gruppe sends the user an activation code to the e-mail address provided. This constitutes an offer to conclude a contract of use on the basis of these terms of use. Acceptance and thus the conclusion of the contract takes place by entering the activation code on the platform.
    4. The contract is stored by the EW Gruppe, but is not accessible to the user. The user can view their stored data via the "Settings" menu item. The Terms of Use can be accessed at any time via the "Terms of Use" link, but only in their current version.
    5. The contract can be concluded in German or English.
    6. Users must be at least 16 years old or have the consent of their parents or guardians to use the platform.
  3. Access and use of the platform
    1. The platform documentation is intended exclusively for employees, customers, investors and partners of companies that have entered into a corresponding agreement with the EW Gruppe. Persons who do not fulfil these requirements are prohibited from using it.
    2. Authorisation for use is granted by EW Gruppe after the user has registered on the platform.
    3. The user must inform EW Gruppe immediately if he/she leaves the company for which he/she originally had access to the platform as an employee.
    4. Access data may not be passed on. The user must keep them secret and change the access data immediately if they become aware of third parties who have had access.
  4. Confidentiality of content and contractual penalty
    1. The content on the platform is based on confidential company information. It may only be made accessible to authorised users.
    2. The content is strictly confidential and may not be passed on to third parties. Screenshots and publication on the Internet are expressly prohibited.
    3. The user may not pass on content to third parties, and in the event of culpable infringement, a contractual penalty of EUR 10,000 per infringement, but not more than EUR 40,000 in total, shall apply. Further claims for damages remain unaffected.
    4. EW Gruppe may exclude the user in the event of violations and points out that violations may be prosecuted.
  5. Termination of the licence agreement, discontinuation, restriction or modification of content and deactivation of the user account
    1. The user can terminate the user contract at any time without giving reasons by deactivating his user account by e-mail to info@ewgruppe.net with the subject "Deactivate access", without observing a notice period.
    2. EW Gruppe may terminate, restrict or change the free provision of the platform at any time. The contract of use can be cancelled with a notice period of two days by notifying the user in text form.
    3. In the event of breaches of sections 3.2, 4.2 and 4.3, EW Gruppe may immediately block the user account without notice and terminate the licence agreement. Further claims remain unaffected.
    4. Upon termination or cancellation, the user account will be deactivated, personal information will be removed, content and discussions will remain anonymised.
  6. Participation in dispute resolution procedures and information on online dispute resolution
    1. As an online company, the EW Gruppe refers to the ODR platform of the European Commission (https://webgate.ec.europa.eu/odr), but does not participate in consumer arbitration proceedings.
  7. Final provisions'
    1. EW Gruppe reserves the right to change these Terms of Use at any time without giving reasons. The user will be informed of any changes and accepts them upon registration.
    2. German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods, unless the consumer is deprived of the protection afforded by the mandatory provisions of his country.
