The Location licence granted for the construction and operation of an upcycling power plant (UCC plant) is valid for an unlimited period of time and gives the licensee the option of transferring the operating right to a third party even after the plant has been discontinued. This transfer can take place not only to another operator, but also to a completely different location. The process of selling and finding a location is the responsibility of the licence holder, who must take the necessary steps independently.
Transfer of licence[edit | edit source]
The transfer of the licence from an original licensee to a new licensee requires the approval of EW Gruppe GmbH, which grants this approval as the holder of the exclusive licence. In the event of a licence transfer, a fee of 1% of the sales proceeds is payable to EW Group to honour the use and transfer of the exclusive licence.
Location selection and authorisation[edit | edit source]
It is also important to note that when selecting a new site, written authorisation must be obtained in advance from the EW Group. This approval ensures that the selected site is not already occupied by the site licence of another licensee and thus guarantees the exclusivity and legality of operations at the new site. This regulation serves to avoid potential conflicts over site rights and to protect the interests of all licencees.
